Account Terms and Conditions

This is a contract. It spells out terms= and conditions of access to Jackpine Internet Service and outlines your = and our responsibilities. It also limits our liability. By using the service your are deemed to agree to the terms and conditions contained on all pages which are identified with your account classificatio= n.

Jackpine may be used only for lawful purposes. Transmission or solicitation for reception of material that viola= tes US Federal or Michigan State Law, or State Law of the state from which you = are transmitting or receiving is strictly prohibited. Specifically, by using the service, you are deemed to agree not to knowingly transmit or receive mater= ial that is threatening, legally obscene, libelous or violates trade-secret, pa= tent or copyright protections while using Jackpine Internet Service.

You agree to indemnify and hold harmless Jackpine and its owners from all claims that are a result of your usage, without limitation.

Jackpine makes no warranties or representations of any kind for the services that are being provided. We explicitly disclaim any warranty of merchantability or fitness for any purp= ose whatsoever. We are not responsible for any loss you su= ffer as a result of using Jackpine Internet Service, including but not limited to loss resulting from delays, improper or incomplete delivery of information, possible "computer viruses" or interruption of service, regardles= s of cause. We do not guarantee the continued availability of any services offer= ed on the Internet at the time of contract signing.

Notwithstanding the above, you agree th= at should we be found liable in a court of law for any action or lack of action related to your use of Jackpine Internet Service, our liability is limited = to the unused portion of your subscription fee.

Electronic Communication Privacy Act of 1986-NOTICE: We reserve the right to monitor any and all communications thr= ough or with Jackpine Internet Service. You agree that Jackpine Internet Service= are not to be considered a secure communications medium for the purposes of the ECPA, and that no expectation of privacy is afforded.

You agree that the security of your acc= ount, including the password, is your responsibility and that all use that emanat= es from your account will be considered to be undertaken by you unless it can = be shown to have been an unauthorized intrusion. You agree to notify Jackpine. Internet Service immediately if you believe that your account has been or is being compromised.

Dialup accounts are single session acco= unts and as such are restricted to a single connection at any given time. Consum= ing more than one modem line is explicitly prohibited. Violations of this policy will be dealt with as theft of service and will result in backbilling at 64kb Frame Relay rates to the inception of your subscription. Jackpine m= ay also prosecute these violations under civil and criminal law. We are intere= sted in proactively working with you and coming to mutually agreeable terms for multiple session accounts. Please contact us if you need to discuss specific connectivity requirements.

You agree not to obstruct the system's identification procedures in electronic communications which you initiate. Anonymous services may be used provided that you do not attempt to imperson= ate others.

The transmission of unsolicited advertising through mass-electronic mail, Usenet postings to inappropriate groups, or other direct transmission is prohibited. However, posts made to appropriate Usenet groups as well as general commercial use of Jackpine Internet Service is encouraged.

You agree not to abuse the system and i= ts resources including any quotas on disk usage which may be imposed and polic= ies on the use of resources (such as Usenet) which reach beyond this system. You agree not to attempt to violate the security of this system or its authentication and accounting procedures.

You agree to notify us if you move or otherwise change your mailing address. You further agree to provide a regul= ar postal address which is your primary legal residence or place of business. Jackpine will not disclose this information to any third party except upon = the presentation of a valid warrant or court order. We reserve the right to use this information for internal Jackpine purposes and to advise you of new service and product offerings by Jackpine Internet Service. We do not sell = our mailing list to other companies under any circumstances.

Jackpine Internet Service will bill our Customers at the beginning of the month for the current month's service. Payment is due upon the Customer's receipt of the bill. Metered billing for= the previous month, if applicable, will be included on this invoice. If payment= is not received by the end of the current month, the account will be terminated and the customer will be subject to additional connection fees to reestabli= sh the account. Termination does not remove the Customer's responsibility under this Agreement to pay all fees incurred up to the date of termination. Connection fees are due prior to the commencement of service. Upon terminat= ion of a subscriber’s account all data stored in the customer's directori= es will be deleted. Jackpine Internet Service encourages use of "= ;Instant Pay" for = services offered by Jackpine Internet Service.

The Customer may terminate this service= at any time upon thirty days prior written notice. The Customer is responsible to pay all fees up to the date of termination of the service, e= xcept where Jackpine is unable to provide services under this Agreement through <= span class=3DGramE>it's own negligence. Termination will be effective at = the end of the month following the 30th day after Jackpine Internet Service receives notification.

Jackpine reserves the right to change t= hese terms and conditions at any time, as well as the services offered. Posting = of the new terms and conditions or service changes on the system in a conspicu= ous place shall constitute proper notice. Notice of rate changes will be mailed= to customers at least 30 days prior to the date of effectiveness.

Jackpine reserves the right to disclose= the information which can be discerned from the "finger" command to t= hird parties. This normally includes your full name, login id and time of last system access.

Violation of any of the terms and condi= tions of service may result in the cancellation of your subscription and the forfeiture of the remainder of your subscription fee. Serious violation may result in civil or criminal prosecution. Jackpine may discontinue any or all classes of service at its discretion. Should Jackpine exercise this right subscribers will receive a pro-rated refund.

You agree that you are aware that this = system contains the information known as "Usenet News Groups", and that portions of the system may contain messages which you may find offensive. Y= ou further understand that Jackpine does not censor or in any other way control the contents of this information service, and that nearly all of the information found here originates on systems other than those under Jackpine's control. You also understand that Jackpine cannot confirm the proper classification of information presented in many a= reas of the system. You consent to the display or transfer o= f all information presented and waive all rights and claims towards Jackpi= ne Press, Inc., its owners and employees.

Jackpine requires that our agreements b= e made with a person who is qualified to contract. If you are the guardian or pare= nt of a minor who is requesting access, read these pages in their entirety.= There are aspects of this service that are not under our complete control, = and it is important that you understand and agree with these limitations in the classification of material. Some material on this system or available via t= his system may contain adult themes or subject matter. By using the service par= ents and/or guardians agree to the terms of this agreement and agree that Jackpi= ne is not responsible for the content of the materials that may be available.<= /span>

This agreement is available to all user= s of Jackpine Internet Service on the = Jackpine Web Site and all users are prov= ided a copy of this agreement on the signup CD. Continued us of the account is dee= med to be acceptance of all terms.

SERVICES and PRICING.

Jackpine Internet Ser= vice (hereinafter referred to as Jackpine) offers a wide range of services to be able to meet the demands of each and every user. We encourage our customers= to use the "Instant Pay"= plan when selecting your desi= red service. The Mail/News, Basic and Standard services include an automatic disconnect if no activity is detected for 20 minutes. All accounts include = up to 20 Mb of E-mail storage and 2.5 Mb of user st= orage. If more storage is required, please contact Jackpine..

Economy Dial Up Service includes a PPP connection, an E-mail box on our system,= and 30 hours of service each month. Economy service is ideal for an individual = who wants to see what the net is all about or someone who uses email only.

<= b>Inactive Account status is available for $2.50= per month. If you go away for the winter, this may be for you. Your email addre= ss remains open and can be accessed form anywhere on the Internet. Simply call= us when you come back and your account will be reactivated with no activation = fee.

<= b>Domain Name Registration Jackpine will handle domains registration for you for a current fee of between $17.95 and $29.95. Domains registration must be maint= ained in order to use and preserve your domiain name = on the world wide web.= Discounts apply to multiyear registrations.

<= b>Domain Hosting Jackpine will host a domain i= f the customer has an account with Jackpine Internet Service. The charge is $10.00 per month and $25.00 set up

<= span class=3DGramE>World W= ide Web Page Development. Jackp= ine can create a World Wide Web presence for your business or organization according to your specifications using existing artwork, such as brochures, catalogs or letterhead. If artwork is not available, we can create it. Web = Page creation and editing is billed at $45.00 per hour. Call us to discuss your project, we will be happy to provide you with a quotation.

<= b>Software Jackpine supports all major internet software including but not limited to Internet explorer, Firefox, Outlook, Outlook Express, Thunderbird, Eudora, Chrome, Safari, and Windows Mail.

<= b> Modems We support all standard PC Modems, but do not gu= arantee the functionality of your modem. We can provide you with a wide variety of internal or external modems from the leading modem vendors. 33.6 Kbps, and 56 Kbps. Modem speeds a dependent on the qua= lity of the phone line and are not guaranteed.
